$375 Million Recovery in Trade Secret Dispute
Led trade secret litigation for a global investment firm in a case involving financial services technology. Developed case strategy, identified primary trade secrets, and managed fact/expert discovery and pre-trial. Defeated summary judgment and Daubert challenges to a $1 billion damages claim. The matter resolved through mediation for $375 million in the client’s favor.
Defense of Spinal Cord Stimulator Manufacturer — Trade Secret and Patent Litigation
Represented a medical device company in a patent infringement and trade secret misappropriation case spanning six years. Worked with technical experts to prepare reports that effectively eliminated the opposition’s trade secret damages claims. The litigation resolved with a settlement in the client’s favor.
Invalidation of Cloud Storage Patents
Represented a software company as declaratory judgment plaintiff and a major retailer as defendant in district court actions involving remote storage technology. Successfully invalidated three of four asserted patents under § 101 at the motion-to-dismiss stage, leading to the case settling in the clients’ favor.
Biologic Manufacturer Prevails in BPCIA Preliminary Injunction Proceedings
Represented a major biologic manufacturer in a BPCIA action. Managed significant portions of the discovery effort in support of preliminary injunction proceedings. The parties settled, with the generic manufacturer agreeing to a temporary injunction.
Medical Device Manufacturer Defeats § 101 Challenge
Represented a medical device manufacturer in a five-patent case involving technology for manufacturing cranial orthotics. Successfully defeated a § 101 challenge at the motion-to-dismiss stage.
Global SEP Patent Litigation — Telecommunications
Represented major smartphone and telecommunications equipment manufacturers in coordinated global patent infringement and antitrust litigation involving alleged standard-essential patents and FRAND licensing obligations. Managed technical discovery and prepared non-infringement and invalidity expert reports and related IPR petitions.
Consumer Electronics Company Prevails in ITC Investigation
Represented a major consumer electronics company at trial in an ITC investigation involving patented noise cancellation and digital audio signal processing technology. Obtained initial determination of no infringement, no technical domestic industry, and no standing, affirmed by the Commission.
Defense of Consumer Electronics Company in Global Smartphone Litigation
Member of trial teams representing a major consumer electronics company in global ITC and district court litigation involving the design and functionality of smartphones and tablet devices. Prepared infringement, non-infringement, validity, and invalidity contentions and associated expert reports.
Video Game Publisher Prevails in Copyright and Trade Dress Action
Represented a major video game publisher in a copyright infringement, trade dress infringement, and unfair competition action regarding improper use of computer assets related to a major online battle royale game. Researched and documented defendants’ use of copyrighted material and drafted pleadings and oppositions to motions to dismiss.

Ketan Patel is a patent and trade secret litigator with fifteen years of experience representing clients in high-stakes intellectual property disputes in federal courts, the International Trade Commission, and before the USPTO. His practice spans a wide range of technologies, including medical devices, cloud software, semiconductors, wireless communications, standard-essential patents, video games, audio codecs, financial software, and streaming media.
Before joining Villegas & Cefo, Ketan served as Head of Litigation and Intellectual Property at a global investment firm. Prior to that, he spent seven years as a Senior Managing Associate at Sidley Austin LLP and began his career at Quinn Emanuel Urquhart & Sullivan LLP. Ketan also served as a law clerk to the Honorable Mary Pat Thynge, United States Magistrate Judge for the District of Delaware.
